By accessing or using the Favor Wheel mobile application and website at favor-wheel.com (the "Service" or "Favor Wheel"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Favor Wheel is operated by Favor Wheel LLC ("Company," "we," "our," or "us").
You must be at least 18 years old to use Favor Wheel. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
Favor Wheel is a platform that connects users who wish to exchange services with each other. The Service allows you to create a profile listing services you can offer and services you need, browse other users' profiles in your geographic area, match with compatible users, communicate with other users, and arrange service exchanges.
Important: Favor Wheel is a platform only. We do not provide the services listed by users, nor do we employ or control any user. We are not responsible for the quality, safety, legality, or delivery of any services exchanged through the Service.
Favor Wheel may offer paid membership at the price displayed at the time of sign-up (currently $4.99 per month). Membership grants access to platform features; it does not entitle you to any specific service from another user, and all exchanges between users remain cashless and at the users' discretion. Fees are billed in advance and are non-refundable except where required by law. We may change membership pricing on a going-forward basis with notice.
We reserve the right to suspend or terminate your account at any time for violation of these Terms; fraudulent, abusive, or illegal activity; behavior that harms other users or the Favor Wheel community; or extended account inactivity.
Favor Wheel provides the platform for users to connect and arrange exchanges. We are not a party to any service exchange agreement between users.
We do not guarantee the quality, safety, or legality of any services; the truth or accuracy of user profiles; that users will fulfill their agreements; or that any particular exchange will be successful.
You may not offer or request services that require professional licenses you don't have (e.g., medical or legal services without proper credentials); involve sexual services or adult entertainment; involve illegal drugs or controlled substances; facilitate illegal activity; involve weapons or explosives; or violate intellectual property rights. We reserve the right to remove listings for any services we deem inappropriate.
You retain ownership of content you post (profile information, messages, reviews). By posting content, you grant Favor Wheel a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with operating the Service. You represent that you own or have rights to all content you post, and that it does not violate any third-party rights or any laws.
The Service, including its design, features, graphics, and code, is owned by Favor Wheel LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
Reviews must be honest and based on actual service exchanges. You may not post fake reviews or reviews in exchange for compensation. We reserve the right to remove reviews that violate these Terms and are not responsible for user-generated reviews.
Your use of Favor Wheel is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
When meeting other users: meet in public places for initial meetings; tell someone where you're going; trust your instincts—if something feels wrong, cancel; verify the identity of users before providing services; and be cautious about sharing personal information. Favor Wheel is not responsible for in-person interactions between users.
Disputes arising from service exchanges are between users. We encourage users to resolve disputes amicably. Favor Wheel is not obligated to mediate disputes but may offer assistance at our discretion. You agree to release Favor Wheel from any claims, demands, or damages arising from disputes with other users.
FAVOR WHEEL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE IS FREE OF HARMFUL COMPONENTS, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAVOR WHEEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, SERVICE EXCHANGES ARRANGED THROUGH THE SERVICE, CONDUCT OF OTHER USERS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO USE THE SERVICE IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
You agree to indemnify and hold harmless Favor Wheel LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, services you provide through the Service, or content you post.
We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time with or without notice. We may also update these Terms periodically; material changes will be communicated through in-app notification, email, or posting with an updated "Last Updated" date. Continued use after changes constitutes acceptance.
You may stop using the Service and delete your account at any time. We may terminate or suspend your access immediately, without notice, for violation of these Terms, fraudulent or illegal activity, behavior harmful to other users or Favor Wheel, or any other reason at our discretion. Provisions that should survive (indemnification, limitation of liability, dispute resolution) remain in effect after termination.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Favor Wheel. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not waive our right to enforce it later. You may not assign these Terms; we may assign them without restriction.
